Terms of Service

By creating an account, accessing, or using Trively, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. These terms constitute a legally binding agreement between you and Trively (Joan Navarro Palatsi, NIF 47479622D). If you are using Trively on behalf of an organization, you represent that you have the authority to bind that organization to these terms. In such cases, "you" and "your" refer to both you individually and the organization.

Trively is a travel planning and management application that allows you to create, organize, and share travel itineraries. The Application enables you to plan trips, add activities and destinations, upload travel documents, view locations on interactive maps, connect with other travelers, and manage all aspects of your travel plans in one place.

We strive to provide a reliable and high-quality service, but we do not guarantee that the Application will always be available, uninterrupted, error-free, or free of harmful components. We may temporarily suspend or restrict access to the Application for maintenance, updates, or other operational reasons without prior notice.

Eligibility: You must be at least 16 years old to create an account and use Trively. By registering, you confirm that you meet this age requirement and have the legal capacity to enter into these terms.

Registration: You may register using your email address or through third-party authentication providers (such as Google or Apple). You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us at trively@navarropalatsi.dev if you become aware of any unauthorized use of your account. Trively shall not be liable for any loss or damage arising from your failure to safeguard your account.

You agree to use Trively only for lawful purposes and in accordance with these Terms. You shall not:

Use the Application for any illegal, fraudulent, or unauthorized purpose that violates applicable local, national, or international laws or regulations.

Send spam, chain letters, pyramid schemes, or any other form of unsolicited or excessive communication through the Application's features.

Attempt to reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or underlying structure of the Application or any of its components.

Interfere with, disrupt, or overload the Application's infrastructure, servers, or networks, or attempt to gain unauthorized access to any part of the Application.

Use automated tools, bots, scripts, or scrapers to access or interact with the Application without our express written permission.

Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

Application Content: All content, design, graphics, code, trademarks, logos, and other intellectual property associated with Trively are the exclusive property of Trively (Joan Navarro Palatsi) or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Application or its content without our prior written consent.

User Data: You retain full ownership of all data, itineraries, documents, and content that you create, upload, or share through the Application. By using Trively, you grant us a limited, non-exclusive license to process your data solely for the purpose of providing you with the service. This license terminates when you delete your account.

Trively is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by applicable law, Trively (Joan Navarro Palatsi) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, travel plans, or business opportunities arising out of or in connection with your use of the Application.

We do not guarantee uninterrupted, timely, or error-free service. We are not responsible for any disruptions, data loss, or damages resulting from third-party services, network failures, or circumstances beyond our reasonable control.

Termination by You: You may delete your Trively account at any time through the Application's settings or by contacting us at trively@navarropalatsi.dev. Upon account deletion, your personal data, itineraries, and uploaded documents will be permanently removed from our systems within a maximum period of 30 days, in accordance with our Privacy Policy.

Termination by Trively: We reserve the right to suspend or terminate your account at our sole discretion if we reasonably believe that you have violated these Terms of Service, engaged in conduct that may be harmful to other users, the Application, or our business, or if required by applicable law. We will make reasonable efforts to notify you prior to such action, except where immediate action is necessary to protect the safety of users or the integrity of the platform.

Plans: The Application can be used free of charge in its basic version. Certain premium features require a paid subscription (currently monthly, billed via Stripe). The price and the features of each plan are displayed in the Application before you subscribe.

Automatic renewal: Paid subscriptions renew automatically at the end of each billing period, unless you cancel them before the renewal date. The renewal charge will be made with the payment method you saved during the subscription.

Cancelling your subscription: You can cancel the automatic renewal of your subscription at any time from the Application's Settings. Once cancelled, the subscription stays active until the end of the billing period already paid, and your account then falls back to the free version. Amounts corresponding to already-billed periods are not refunded on cancellation.

Payments and refunds: As a consumer, where mandatory consumer law applies you benefit from the legally recognised withdrawal and refund rights described in that law, without prejudice to what is stated in this section. When starting a subscription, the payment form is processed by our payment provider Stripe, subject to its terms of service and privacy policy.

Prices: We may update the price of the paid plans, notifying you in advance with reasonable notice. The price change will only apply to new billing periods if you keep the subscription.
